Minutes of the August 8, 2000 Special Meeting

 

The meeting convened at 12:00 PM in the Adams Leadership Center with President Steve Percival presiding.

Roll Call

The roll was called and board members Pam Grondin, Howard Hamilton, Laura Underwood, Steve Percival, Malcolm McNair and Reed Greenwood were present.

Amendment 59 Settlement

Dr. New read an introductory statement to the Board in which he expressed his views on the settlement issue. He also recognized the hard work and dedication of Mr. Rudy Moore and Ms. Lisa Morstad and thanked them for their tireless efforts on this project. Dr. New then made the recommendation to agree with the terms of the Amendment 59 settlement, which is offered by the plaintiffs’ attorneys.

Rudy Moore, legal counsel for the district, explained the terms of the settlement agreement. These terms stipulate a settlement amount of $6.78 million, 33.3% of which would go for attorneys’ fees. All terms of the settlement are subject to court approval on September 5th by Judge Danielson. Mr. Moore further explained the details of the refund process.

Dr. Greenwood made the motion to accept the terms of the settlement offer. Mr. McNair seconded the motion, which passed by a vote of 5-1.

Adjournment

Dr. Greenwood made the motion to adjourn, which was seconded by Mr. Hamilton. The motion to adjourn was passed by a 6-0 vote and the meeting was adjourned at 1:05 PM.
